Ish Kumar vs. Nadir Shah

July 3, 2024

In this case, Ish Kumar filed an application under Section 156(3) of the Criminal Procedure Code (CrPC) to request the registration of an FIR against Nadir Shah and others for serious allegations, including kidnapping, extortion, and ransom demands. The case revolves around the sale of a second-hand car, during which the complainant, Ish Kumar, was allegedly abducted, held captive, and forced to pay a ransom of ₹50 lakhs.

Key Allegations:

Ish Kumar was approached by Nadir Shah and associates to buy a Mahindra Scorpio for ₹11 lakhs.

Upon paying part of the token money, Kumar was kidnapped, beaten, and held for four days.

The accused allegedly threatened Kumar with false income tax cases and demanded ₹50 lakhs for his release.

The accused tracked Kumar to Jaipur and continued their threats and extortion.

Court Proceedings:

The police initially dismissed the case, stating that the crime did not fall under the jurisdiction of PS Amar Colony.

However, a Vigilance inquiry revealed that certain police officers were in close contact with the accused, raising suspicions of collusion.

The court ruled that the allegations were serious enough to warrant police investigation and directed the registration of an FIR.

The investigation will be monitored by the DCP (South East) due to the involvement of police officers.

This case highlights the legal complexities of kidnapping, extortion, and police involvement in serious criminal allegations.
