Pawan Gupta applied for regular bail under Section 439 of the Criminal Procedure Code (CrPC) for charges related to forgery and fraud under Sections 420, 467, 468, 471, 120B, and 34 of the Indian Penal Code (IPC). The case stemmed from a property dispute with his brother, who alleged that Gupta forged documents to fraudulently claim ownership of their shared property.
Despite the serious nature of the charges, the court noted that all evidence was documentary and already in the possession of investigators, minimizing the risk of tampering. Additionally, the case was not expected to go to trial soon, and prolonged incarceration would deprive Gupta of his legal defense.
The court granted bail under strict conditions, including a personal bond of ₹20,000 with two sureties. Gupta was required to attend all court hearings, refrain from tampering with evidence, and remain within the country unless permitted otherwise.
