Rakesh Meena filed a bail petition in the Supreme Court of India, challenging the rejection of his previous bail application by the Rajasthan High Court. The petition pertained to an FIR filed under Sections 8/15, 8/17, and 8/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act).
Meena's argument was that he was not the owner of the farm where the narcotic substances were found; he was merely working there. He pointed out that a co-accused in a similar situation had already been granted bail by the Rajasthan High Court in a separate case. Meena sought the same treatment.
After reviewing the case and hearing arguments from both sides, the Supreme Court granted bail to Rakesh Meena, setting aside the Rajasthan High Court's order. The trial court was instructed to set the terms and conditions for his bail.
This case highlights the Supreme Court's role in ensuring equitable treatment for co-accused individuals in similar circumstances, especially under the stringent NDPS Act.
